The Bharatiya Janata Party-led Assam government is set to introduce a new law mandating a six-month notice period before marriage. Chief Minister Himanta Biswa Sarma announced the legislative shift during a session in the Assam Assembly, with the law expected to be implemented in April next year. This move aims to address growing concerns over elopements and fraudulent practices associated with marriage, ensuring that the institution retains its respect and sanctity.

Chief Minister Sarma highlighted the issues surrounding elopement and instant marriages, which he believes have undermined the institution of marriage.

The proposed law is designed to tackle these problems by extending the notice period, allowing sufficient time for both parties to consider their decision. This change comes in response to societal concerns that the current one-month notice under the Special Marriage Act of 1954 is insufficient to prevent hasty decisions that may lead to fraudulent or coerced marriages.

Extending the Notice Period: Protecting the Institution of Marriage

Under the existing legal framework, a one-month notice is required for interreligious marriages as per the Special Marriage Act. However, the Assam government plans to extend this period to six months, reflecting its commitment to maintaining the sanctity of marriage. By introducing this longer notice period, the government aims to provide more time for due diligence, ensuring that marriages are entered into with full consent and awareness by both parties. This proposal aligns with the state’s broader efforts to reform personal laws and protect the institution of marriage.

In addition to the six-month notice law, the Assam government has also introduced a bill aimed at making the registration of Muslim marriages and divorces mandatory. The Assam Compulsory Registration of Muslim Marriages and Divorces Bill, 2024, was presented in the Assembly by Revenue Minister Jogen Mohan, sparking debate among lawmakers. The bill seeks to replace the outdated Muslim Marriages and Divorces Act of 1935, which has been criticized for allowing child marriages and lacking provisions against polygamy.
